By accessing or using the NexImmigration AI platform ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may update these Terms at any time by posting a revised version. Material changes will be communicated via email or prominent notice on the Service at least 30 days before they take effect. Your continued use after the effective date constitutes acceptance. These Terms were last updated on March 23, 2026.

NexImmigration AI provides AI-powered immigration guidance tools including:

• Interactive text and voice consultations with an AI assistant
• Guided USCIS form preparation and validation
• Document checklists, timeline estimates, and case tracking
• Knowledge base search grounded in USCIS published materials

The Service supports 100+ USCIS forms across 4 languages. The Service is offered in Free, Pro, and Family subscription tiers as described on our Pricing page.

CRITICAL NOTICE: NexImmigration AI is NOT a law firm, NOT a licensed attorney, and does NOT provide legal advice or legal representation.

The Service uses artificial intelligence (large language models) to provide informational guidance only. AI-generated content may contain errors, inaccuracies, or outdated information. You acknowledge that:

• The AI assistant is not a substitute for a licensed immigration attorney
• No attorney-client relationship is created by using the Service
• All AI-generated documents, guidance, and form preparations must be reviewed by a qualified legal professional before submission to any government agency
• Immigration law changes frequently; the AI may not reflect the most recent legal developments
• You assume full responsibility for verifying the accuracy of any information or documents generated by the Service
• For complex, high-stakes, or time-sensitive immigration matters (including detention, removal proceedings, or appeals), you should consult a licensed immigration attorney

We strongly recommend engaging a licensed immigration attorney for all official filings and legal proceedings.

To access certain features, you must create an account. You may also use the Service anonymously with limited functionality. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities under your account
• Notifying us immediately of unauthorized access

You must be at least 18 years old to create an account. You agree to provide accurate, current information and to update it as needed. We reserve the right to suspend or terminate accounts that violate these Terms or that remain inactive for more than 12 months.

You agree NOT to use the Service to:

• Upload or transmit unlawful, fraudulent, or deceptive content
• Submit false information on immigration forms or documents
• Attempt to reverse-engineer, decompile, or extract the AI models, algorithms, or training data
• Use automated scripts, bots, or scrapers to access the Service
• Impersonate any person, government official, or entity
• Interfere with or disrupt the security, integrity, or performance of the Service
• Use the Service to facilitate unauthorized immigration or document fraud
• Circumvent usage limits, rate limiting, or subscription tier restrictions
• Resell, redistribute, or commercialize the Service without written authorization

Violations may result in immediate account termination and may be reported to appropriate authorities.

All content, software, AI models, algorithms, designs, and technology on the NexImmigration AI platform are the exclusive property of NexImmigration AI and its licensors, protected by U.S. and international copyright, trademark, and intellectual property laws.

You retain ownership of content you input into the Service ("User Content"). You grant us a limited, non-exclusive license to process your User Content solely to provide the Service.

We do NOT use your immigration case data, personal information, or conversation content to train our AI models. Generated outputs (form drafts, guidance text) are provided under a limited license for your personal immigration purposes only.

Free tier users receive limited consultations and form access per month as described on the Pricing page. Pro and Family tiers require a monthly subscription. Payments are processed securely through our third-party payment processor.

You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We offer a 30-day money-back guarantee for first-time subscribers. Prices may change with 30 days' notice. Refunds are not available for partial billing periods after the guarantee period.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXIMMIGRATION AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS OR REVENUE; IMMIGRATION APPLICATION DENIALS, DELAYS, OR ADVERSE OUTCOMES; RELIANCE ON AI-GENERATED CONTENT; LOSS OF DATA; OR EMOTIONAL DISTRESS — WHETHER IN CONTRACT, TORT, OR OTHERWISE.

Our total aggregate liability for any claim arising from the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100.00.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.

You agree to indemnify, defend, and hold harmless NexImmigration AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your submission of inaccurate or fraudulent information
• Any immigration filing or application you make based on Service outputs without professional legal review

This indemnification obligation survives termination of your account.

We may suspend or terminate your access immediately for violations of these Terms, fraudulent activity, or at our discretion with 30 days' notice. Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination. Sections 3, 6, 8, and 9 survive termination.

These Terms are governed by the laws of the State of South Carolina, USA, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration in Greenville, South Carolina, under the rules of the American Arbitration Association.

You waive any right to participate in class action lawsuits or class-wide arbitration.
